Karan Johar Moves Bombay High Court to Block Release of Film Using His Name

Bollywood filmmaker Karan Johar has filed a suit against the makers of the upcoming Hindi film "Shaadi ke Director Karan aur Johar," seeking an urgent stay on its release scheduled for June 14, 2024. Johar's plea challenges the film's title itself, which directly incorporates his name.


Johar objects to the use of his name in the film title

The petition, filed before Justice RI Chagla's bench of the Bombay High Court, argues that Johar has no connection whatsoever with the film or its makers. He contends that the use of his name in the title is unlawful and a violation of his personal rights, including his right to publicity and privacy. By using his established name as a "brand name" without authorization, Johar claims the filmmakers are exploiting his goodwill and reputation for their own benefit.

The petition further argues that promotional materials like trailers and posters featuring the film's title have already caused "irreparable loss and damage" to Johar's reputation. These materials, Johar asserts, create the impression that he is associated with the film in some way, which is demonstrably false.

Johar's legal team is seeking a permanent injunction, effectively preventing the filmmakers from using his name in the film's title. Additionally, the petition seeks a restraining order barring the film's release until the court reaches a final decision.

Beyond the title change, Johar has also requested that the filmmakers be directed to remove any reference to his name or personality from their website and social media platforms. He also wants them to issue a public clarification stating that the film has no connection to him whatsoever.


Filmmakers yet to respond

"Shaadi ke Director Karan aur Johar" is co-produced by IndiaPride Advisory Pvt. Ltd. and Sanjay Singh, with Bablu Singh helming the director's chair. Trailers for the film have already been released on platforms like YouTube and Instagram, and posters featuring the disputed title are displayed in public areas across Mumbai.

As of today, June 13, 2024, the filmmakers have not issued any public response to Johar's lawsuit. The Bombay High Court is scheduled to hear the plea on Thursday, June 14.

This case raises interesting questions about the unauthorised use of a public figure's name for commercial purposes. Indian law recognises the right to publicity, which protects an individual's name, image, and likeness from unauthorised commercial exploitation.

The court's decision will be watched closely by the Indian film industry, as it could set a precedent for future cases involving the use of celebrity names in film titles and promotional materials.
